Summary of rights when buying online:

When you buy products or services online you are entering into a contract called a distance contract. A distance contract is where you buy a product or service online, over the phone, by mail order, or from a door-to-door salesperson.

With this type of contract, you do not enter into the contract in person and you cannot check the products before you buy. Because of this, you have additional protections under EU law.

 

The Consumer Rights Directive 2011/83/EU (CRD), gives you extra rights when you enter into a distance contract with sellers based in Ireland and other EU countries. These rights do not apply to consumer-to-consumer deals (that is where you buy from a private individual) or if you buy from a trader based outside the EU.

 

Cooling-off period:

Under the Consumer Rights Directive 2011/83/EU, you have 14 calendar days to change your mind without having to give a reason. This right to cancel is also known as the ‘cooling-off period’.

Your right to cancel begins from the moment you place the order. Where you have purchased products (goods), the cooling-off period starts the moment you receive the product. You have 14 days to tell us you want to cancel and then a further 14 days to return the products. For further information, see the ‘how to cancel an order’ section below.

There are certain products that cannot be returned and refunded. These are:

 

  • Personal grooming products or cosmetics (for hygiene reasons if seal opened/removed after delivery)
  • Pierced jewellery (for hygiene reasons if seal opened/removed after delivery)
  • Underwear - if the items are returned unsealed or not in the original packaging (if applicable).
  • Soft furnishings such as muslin squares and pillows (for hygiene reasons if seal opened/removed after delivery)
  • Other sealed products which are not suitable for return for health protection and hygiene reasons and which were unsealed after delivery.
  • Perishable products, such as foodstuffs.

 

This does not apply in respect of faulty, damaged or incorrectly supplied goods where your statutory rights are unaffected.

How to cancel an order:

Before the cooling-off period ends, you should let us know either by email (hello@mamasboobiebox.com) or using or contact form on our website that you want to cancel your order.

If your order was cancelled before you received the product, you will receive a refund within 14 days to the same payment method that you used to make your purchase.

​If you have received the product, you must return it, unused or undamaged in any way at your own cost. Once received your refund will be processed. The products will be at your risk until its has been returned to us safely. We therefore recommend that you use a tracked delivery service to ensure that we receive the products safely.

Delayed or non-Delivery:

We aim to dispatch all orders between 24-48 hours of an order being placed. See here our delivery and shipping policy for more information.

If for any reason your items were not delivered within the agreed timeframes and it has been 30 days since you placed your order, you can ask us to deliver again or cancel your order and receive a full refund.

Faulty Goods:

Under the Sale of Goods and Supply of Services Act 1980, all products that we sell on our website must be:

  • Of satisfactory quality;
  • As described; and
  • Fit for Purpose.

Where any of the products you have purchased from us do not comply with all three of the above, please contact us by email. We will ask you to provide a full description of the issue and photos (where possible). We will first offer a remedy either a repair or a replacement of the product. If this is not satisfactory we will offer a full refund once the products have been returned to us. We will cover the cost of the return of the product to us and upon receipt will assess your eligibility for a refund.
